Fiedler v. U.S. (CDCA 8-1-2024) – USCG Dismissed Under DFE in D/V CONCEPTION Case

Dear Marine Torts & Casualties Committee Members:

Earlier this month, the U.S. District Court for the Central District of California dismissed all claims against the United States as to claims against the USCG for negligent renewal of the dive boat’s COI under the discretionary function exception to the Suits in Admiralty Act and the Federal Tort Claims Act, in this case arising from the deaths of 34 souls aboard the D/V CONCEPTION. We devoted our panel discussion to this casualty at our joint committees’ meeting in California in October 2022.
