MARINE INSURANCE & GENERAL AVERAGE: Spring 2024 Agenda
Dear Committee Members,
In a little over two weeks the Maritime Law Association will start the 125th Anniversary celebrations in New York!
We are pleased to jointly host the Marine Insurance & General Average Committee’s Spring 2024 meeting with the In-House Counsel and Our Oceans Committees. The meeting will be held in the Auditorium for Kennedys Law LLP, which is located on the basement level of 570 Lexington Avenue, New York. The meeting will commence at 2:00 p.m. (EDT). The agenda for the joint meeting is now available at the webpage for the Committee. CLE will be offered for this meeting.
With the Red Sea in most of our minds, the meeting will have two presentations concerning war risks. First, Dr. Jennifer Lavelle, of Clyde & Co., will assess the London Institute War Clauses (Cargo) and Institute Strikes Clauses (Cargo) in light of the latest developments in the Red Sea. She will highlight the recurring themes she sees when advising clients currently insuring cargo traversing the Red Sea, including whether and where there are gaps in coverage. Second, Christopher Maro, Managing Director, Marsh LLC, will discuss P&I excess war and fixed premium war risk covers.
We move next from P&I war risks to P&I underwriting for the carbon transition of vessel operations. Matias Bøe Olsen, Senior Executive Underwriter & Decarbonization Coordinator for the P&I insurer Skuld, will provide us with his considerations for effectively underwriting for the transition.
Finally, Dr. Dieter Schwampe, of counsel to Arnecke Sibeth Dabelstein, considers co-assurance under P&I entries. He cautions that joint liability provisions, which co-assureds may believe to be a protection, can turn against them and make them liable for debts of the member to the Club.
