See linked case reversing the SDTX, which had refused to remand to state court (finding seaman status fraudulently pled), granted D’s MSJ on seaman status, and dismissed the P’s case. The decision analyzes the Court’s prior Sanchez seaman status tests. CTA5 (Judge Carl E. Stewart authors) finds case was improperly removed and instructs SDTX to remand to state court.
