Attached please see September 8, 2022 decision of the District of Columbia that may be of interest to some of you.  After invoking David Foster Wallace’s 2004 essay “Consider the Lobster” in the first sentence, Judge Boasberg went on to find in favor of  NMFS  ruling that the Service reasonably explained how it estimated right whale populations, appropriately assessed what was the best available information, and had met requirements under the Administrative Procedures Act.
