Massachusetts Lobstermen v Ross, No. 18-5353 (DC Cir., December 27, 2019)
Fisheries’s Docs
All,
In the attached decision, the US Court of Appeals for the District of Columbia Circuit holds that the President, by establishing the Northeast Canyons and Seamounts Marine National Monument, did not exceed his authority under the Antiquities Act despite that step having resulted in some adverse impact on the livelihood of fisherman. They had argued, inter alia, that the Antiquities Act did not extend offshore. This decision affirmed that of the lower court.
Happy New Year to your all.
